Here are some of the most common Visa Classifications:     

Employer Sponsored Visas

To be eligible for an Employer Sponsored Visa, a business must first demonstrate its commitment to ensuring the applicant’s training, salary and well-being.

Subclass 482 TSS Visa

  • This classification allows a business to sponsor skilled employees for between 2 and 4 years.
  • The nominated occupation is listed on either the STSOL (Short-term Skilled Occupation List) or MLTSSL (Medium and Long Term Strategic Skills List).
  • Mandatory labour market testing for employers.
  • Genuine position requirements for both the Applicant and prospective employer.
  • Introduction of Skilling Australians Fund to replace current Sponsorship training thresholds.

Changes from 12 August 2018

  • LMT must be for a minimum of 4 weeks 
  • Be undertaken in the 4 months immediately prior to lodgement 
  • Salary must be advertised unless higher than $96,400
  • Skills and experience must be advertised
  • Alternative arrangements are available for positions annual earnings over $250,000

Subclass 186 Employer Nomination Scheme (ENS)
  • This visa allows a business to sponsor an applicant for permanent residency in metropolitan areas of Australia.  Two steams available are:
  • Temporary Residence Transition Stream - for 457/482 Visa Applicants, who have worked for the same employer for 2 years (457 visa) or 3 years (482 visa) prior to being nominated for permanent residence by the employer.
  • Direct Entry Stream - for Applicants, who have not worked or only briefly worked in Australia and are nominated by an Australian employer for permanent employment based on their skill set.

Subclass 187 Regional Sponsored Migration Scheme (RSMS)

  • This visa allows a business to sponsor an applicant for permanent residency in regional areas of Australia.

Subclass 457 and Subclass 482 - nomination training contribution charge 

The nomination training contribution charge will be calculated in the following manner:

Base amount x visa period

The base amount for organisations with less that $10 million annual turnover is $1200, in any other case the base amount is $1800.

* The charge for nomination of the occupation of Minister of Religion under the LA stream is nil.

Subclass 186 and Subclass 187 - nomination training contribution charge 

  • If the annual turnover of the nominating organisation is less than $10 million - $3000.
  • If the annual turnover of the nominating organisation is more than $10 million - $5000.
  • The charge for nomination of the occupation of Minister of Religion made under the LA stream is nil

 There are provisions for refunds of the Skilling Australian Fund Levy amounts under certain circumstances.

Business Visas

If you a Senior Executive, own a business or have a proven investment portfolio, you may be eligible for a Business Skills Visa. However, the criteria for a successful application changes regularly so keeping up with the latest adjustments is essential for improving your chance of a successful application.

Applicants must show proof of business ownership or a successful investment portfolio. They must also show that they are committed to setting up business in Australia and that the expected turnover meets minimum required benchmarks.

Once a successful applicant sets up a business in Australia, they may then go on to apply for permanent residency.
